A Fire Risk Assessment (FRA) isn't just good practice — it's a legal requirement for almost all non-domestic premises in England and Wales. Under Article 9 of the Regulatory Reform (Fire Safety) Order 2005, the Responsible Person (usually the owner, employer or landlord) must carry out — and keep up to date — a suitable and sufficient assessment of the fire risks on the premises.
Where it forms part of the law
The Regulatory Reform (Fire Safety) Order 2005 (Article 9) — enforced by local Fire & Rescue Authorities, who can inspect, issue enforcement notices or prosecute.
Whose duty it is
The Responsible Person — the employer, owner, or anyone in control of the premises — must ensure the assessment is done, reviewed and acted upon.
Why it must be done
To identify fire hazards, people at risk and the actions needed to keep occupants safe — and to prove compliance to inspectors, insurers and auditors.
